What is non-profit law?
Non-profit law governs non-business, non-government organizations that are designed explicitly to make the world a better place. Just like for-profit organizations, these can be structured in many different ways, provincially and federally. Non-profit law is just as complex as for-profit law and in some cases, particularly tax exemptions, it can be even more complex.
What defines a non-profit organization?
Non-profits are organizations that conduct business for the benefit of the general public without using shareholders. They can sell goods and services, collect money, pay employees, and do everything else that a for-profit organization can do, but they are also governed by a mandate to create social or environmental good rather than profit for their stakeholders.
What’s the difference between a charity and a non-profit?
Charities are a type of non-profit organization. Charitable organizations are exempt from paying certain taxes and goods and services sold by the charity are often GST/HST exempt. They can also provide tax receipts to their donors.
In general, non-profits are easier to register and govern but enjoy fewer tax benefits. By definition, they must conduct operations for the benefit of the public and any money accumulated should go right back into the organization. Non-government organizations also fall under the non-profit definition.
